New Bona Fide Service Fee (BFSF) Reporting Requirement

Beginning with Q2 ASP reporting, manufacturers are required to submit to CMS their Reasonable Assumptions and supporting documentation related to Bona Fide Service Fees (BFSFs). While implementation was delayed by one quarter, the first submission is now due July 30 and additional postponements are not anticipated. CMS released an updated form which can be found here along with instructions and related FAQs.

340B Remains in the Spotlight

Congressional scrutiny of the PHS/340B Program remains strong. Recently, U.S. Senator Bill Cassidy, M.D. (R-LA), Chairman of the U.S. Senate Health, Education, Labor, and Pensions Committee (HELP) Committee, released a legislative discussion draft proposing additional transparency and oversight measures for the 340B Program. The proposal is available in the complete 88-page proposal, a three-page summary, or a one-pager. Although Senator Cassidy will not return to the Senate next year, Senator John Thune (R-SD) has reportedly indicated he is committed to continuing these reform efforts.
